Terms of Service

These Terms govern your use of Content Engine Cloud (the “Service”), operated by Vatai-Gáspár Kata e.v. (“we”, “us”), a business registered in Hungary at 4032 Debrecen, Károli Gáspár utca 298., tax number 59191063-1-29. Contact: info@theignitingstudio.com. By creating an account you agree to these Terms and to our Privacy Policy.
1. The Service
Content Engine Cloud is a web application that generates social-media captions, YouTube descriptions, blog drafts, and thumbnail images from your source content (transcripts, video URLs, or audio/video uploads), using large language models and image generation models operated by third-party AI providers. The Service also lets you push generated drafts to Publer for scheduling.
2. Eligibility and account
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account and for all activity under it.
3. Your content and licences
You retain ownership of everything you upload (transcripts, face photos, reference thumbnails, and any source material) and of the outputs the Service generates for you. You grant us a limited licence to process your content solely as needed to operate the Service (transmitting it to the AI sub-processors listed in our Sub-processors page, storing it under your account).
You warrant that you have the right to upload each piece of content — including any face photo you upload (either your own or with the depicted person’s permission), and any copyrighted material you feed as a source (own work, licensed work, or fair-use excerpt). You are solely responsible for how you use the outputs.
4. Prohibited use
You may not use the Service to:
- Upload photos of other people without their explicit consent
- Generate content that impersonates real people in a misleading way, or that constitutes defamation, harassment, or non- consensual sexual content
- Generate spam, mass-market outreach, or election-related content without required disclosures under the EU AI Act
- Attempt to reverse-engineer the Service, bypass rate limits, scrape the app, or interfere with other users
- Resell the Service or provide agency-style access to your account beyond the seat count of your subscription tier
We may suspend or terminate an account that breaches this section without refund.
5. AI outputs — no warranty of accuracy
The Service uses AI models that can produce inaccurate, fabricated, or biased content. We do not warrant that outputs are accurate, complete, non-infringing, or fit for any particular purpose. You must review outputs before publishing them.
Where you publish AI-generated content on public platforms, you are responsible for complying with the EU AI Act (Regulation 2024/1689) Article 50 transparency requirements — including marking AI-generated images that could be mistaken for real photographs.
6. Subscription and billing
Paid subscriptions renew monthly at the price shown at checkout (in USD). Payment is processed by Polar.sh; local taxes may be added by Polar at checkout. Your subscription remains active until you cancel; cancellation takes effect at the end of the then-current billing period. Cancelled subscriptions retain access until period end and do not refund unused portions of the billing period.
We may change the pricing of new subscription tiers with 30 days prior notice by email. Existing subscribers keep their current rate for the remainder of the billing period.
7. Free trial
The Service includes a limited free trial (one full generation without a subscription). We reserve the right to change trial terms or discontinue the trial for future signups. Existing trials are not affected.
8. EU right of withdrawal (14-day cooling-off)
As a consumer resident in the EU, you have the right to withdraw from a paid subscription within 14 days of the purchase date under Directive 2011/83/EU.
At checkout you may (voluntarily) ask us to begin providing the Service immediately and confirm that you understand you lose the right of withdrawal once you have used the Service. If you did not tick that box, or if you ticked it but have not yet used any Service feature, you can withdraw within 14 days by emailing info@theignitingstudio.com with the subject “Withdrawal” and your account email. We will refund the full subscription payment within 14 days.
9. Availability and support
We aim for high availability but do not guarantee uninterrupted access. Planned maintenance is scheduled outside EU business hours where possible. Support is provided by email at info@theignitingstudio.com. We aim to respond within two business days.
10. Limitation of liability
To the maximum extent permitted by Hungarian law, our aggregate liability arising out of or relating to the Service is limited to the total amount you paid us for the Service in the three months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or lost-profit damages.
This section does not limit liability that cannot be excluded under Hungarian consumer-protection law (including for wilful misconduct or gross negligence).
11. Termination
You can cancel your subscription and delete your account at any time in the Settings page. We may suspend or terminate the Service for a user who materially breaches these Terms, with notice by email except where immediate suspension is needed to protect other users or the Service.
12. Governing law and jurisdiction
These Terms are governed by the laws of Hungary. Disputes will be brought before the courts of Budapest, Hungary. This does not deprive you of consumer-protection rights available in your country of residence.
13. Changes to the Terms
We may update these Terms. Material changes will be communicated by email at least 30 days before taking effect. Continued use of the Service after that period constitutes acceptance.
